The Simons Searchlight 2022 Family & Research Conference (the “Simons Searchlight Meeting”) will take place August 4 to 7, 2022 at the Hyatt Regency Inner Harbor, Baltimore, MD (“Hyatt Regency Inner Harbor”). In exchange for the opportunity to attend the Simons Searchlight Meeting (whether in-person or virtually), the undersigned (“I” or “you”) agree to the terms of this Waiver of Claims and Release (together, “Waiver”) for everyone in your party attending the Simons Searchlight Meeting.
In-person attendees agree as follows:

I am voluntarily attending and participating in the Simons Searchlight Meeting and its related activities at the Hyatt Regency Inner Harbor. I am aware of and agree to accept and assume all risks of personal injury, illness, disability, death, or damage or loss of my property, including, without limitation, the risk of being exposed to or infected with COVID-19 as a result of my actions or those of other attendees or participants, including the Hyatt Regency Inner Harbor’s employees and The Simons Foundation, Inc.’s (“Simons Foundation”) officers, directors, employees, or agents arising from my involvement in the Simons Searchlight Meeting and its related activities.

I will comply with federal, state, and local laws, orders, directives, and guidelines, as well as any protocols or policies implemented or recommended by the Simons Searchlight Meeting or the Hyatt Regency Inner Harbor, while attending the Simons Searchlight Meeting at the Hyatt Regency Inner Harbor August 4 to 7, 2022, including, but not limited to, requirements related to COVID-19, such as hand sanitation, social distancing, and use of face coverings.

I agree not to enter the Hyatt Regency Inner Harbor or attend the Simons Searchlight Meeting sessions if I am experiencing symptoms of the virus (such as cough, shortness of breath, or fever), or if I have a confirmed or suspected case of the disease, or if I have come in contact in the last 5 days with a person who has been confirmed or suspected of having the disease.

I hereby release, for myself, my heirs, and personal representatives, and do forever discharge, indemnify and hold harmless the Simons Foundation, its directors, officers, staff, agents, members, and representatives, from any and all claims, liabilities, actions, damages, costs or expenses of any kind arising out of, in connection with, or relating to my attending or participating in the Simons Searchlight Meeting, including, without limitation, any illness, damages, or injury resulting from my travel to and from, and attendance at, the Simons Searchlight Meeting, participation in events related to the Simons Searchlight Meeting, exposure to an infectious disease (including COVID-19), or the manner in which the Simons Searchlight Meeting or its related events and activities are conducted (collectively, “Claims”). I understand and agree that this Waiver includes, without limitation, any Claims based on the actions, errors, omissions, or negligence of the Simons Foundation or its directors, officers, staff, agents, members, and representatives, whether a condition giving rise to any Claims occurred before, during, or after I attended or participated in the Simons Searchlight Meeting. I understand and agree that the Simons Foundation is not responsible for the Hyatt Regency Inner Harbor’s COVID-19 mitigation efforts (or lack thereof) or any negligence by the Hyatt Regency Inner Harbor or its staff relative to such precautions.
Media policy: I understand that attendees will be required to sign a media release form that covers photography and videography contracted by the Simons Foundation. If you take any informal photos/videos as a conference attendee, please be respectful and ask others’ permission as some attendees may not wish to be photographed or on video.
All attendees agree as follows:

IT or connection issues: The Simons Searchlight Meeting virtual conference sessions are live video conferencing sessions using third-party platforms – namely, CVENT. The content is LIVE, and hence is unmoderated, unfiltered, and unedited. I understand and agree that the Simons Foundation is not responsible for: (1) the general performance of these third-party platforms or technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, internet, or other network hardware or software; (2) unauthorized human intervention in any part of the video conferencing sessions; (3) technical or human error which may occur in the administration of the video conferencing sessions. We will have a CVENT helpline for individuals having difficulties with their viewing experience.

Translation service: The Simons Searchlight Meeting will use third-party language translation services (such as Syncwords) to provide live captions for conference sessions in several languages. Translation services are provided as a convenience to the attendees. We have made reasonable efforts in order to provide accurate translations, however, no automated or computerized translation is perfect and is not intended to replace human or traditional translation methods. The Simons Foundation accepts no responsibility and disclaims any and all liability for damages that may occur due to outdated or incorrect translations rendered by any third-party translation services, including Syncwords.

I understand that the Simons Foundation reserves the right, in its sole discretion, to either reschedule or cancel the Simons Searchlight Meeting or convert the Simons Searchlight Meeting to a solely virtual format without further obligation to you. The Simons Foundation will use its best efforts to provide you with prompt notice in the event it reschedules, cancels, or converts the format of the Simons Searchlight Meeting.
I acknowledge that I have read the Waiver above in its entirety, and I register for the Simons Searchlight 2022 Family & Research Conference with the further acknowledgment that I agree to abide by all the conditions detailed in this Waiver.
Completion and submission of the registration form indicate that you have read and accepted this Waiver for all members of your family.
